1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Contour Maker ("Company", "we", "our", or "us") concerning your access to and use of the Contour Maker website and contour generation service (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

2. Description of Service

Contour Maker provides an online terrain contour generation service that:

• Accepts elevation point data files (TXT, CSV, XYZ, DAT formats)
• Processes the data using multi-scale terrain reconstruction algorithms
• Generates professional DXF contour files for CAD applications
• Provides interactive preview of generated contours

3. User Responsibilities

3.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Upload malicious files or attempt to compromise the Service
• Use the Service to process data you do not have rights to use
• Attempt to reverse engineer or extract our algorithms
• Resell or redistribute the Service without authorization
• Overload the Service with excessive requests
• Use automated tools to access the Service without permission

3.2 Data Accuracy

You are responsible for ensuring that the elevation data you upload is accurate and properly formatted. We are not responsible for output quality issues resulting from inaccurate or improperly formatted input data.

4. Intellectual Property

4.1 Our Intellectual Property

The Service, including its algorithms, software, design, and content, is owned by Contour Maker and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

4.2 Your Data

You retain all rights to the elevation data you upload and the contour files generated from your data. By uploading data, you grant us a limited license to process your data solely for the purpose of providing the Service.

5. Payment Terms

5.1 Pricing

Prices are calculated from dataset coverage area, average point spacing, and contour interval. The current formula is: Price (USD) = Area x 10 x (10 / Spacing) / Interval. Spacing and interval may be clamped to system safety ranges to ensure stable billing.

5.2 Metered Checkout

For hosted providers, we convert the calculated price into a metered checkout subtotal using an integer quantity and a configurable unit price in cents. This may result in an upward rounding of less than one billing unit.

5.3 Payment Processing

Payments are processed through available checkout providers, which may include Creem, Paddle, and PayPal. By making a purchase, you also agree to the terms of the selected payment provider.

5.4 Free Download Allowance

The service may provide a limited free download allowance per client. Eligible jobs can be downloaded without payment until the allowance is exhausted.

5.5 Currency

All prices are displayed in US Dollars (USD).

6. Delivery

Upon successful payment, you will receive immediate access to download your generated DXF file. Download links remain active for 1 hour after generation. If you experience any issues with downloading, please contact us promptly.

7. Refunds

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness of results

We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONTOUR MAKER SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Damages arising from your use or inability to use the Service
• Damages exceeding the amount you paid for the specific transaction

10. Indemnification

You agree to indemnify and hold harmless Contour Maker and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Data you upload to the Service

11. Service Modifications

We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Contour Maker operates, without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
